You have a responsibility to those you care about to plan for your death or incapacitation.
Every adult should have an estate plan in place. Even if you are young or have little in the way of savings, working with an attorney to develop an estate plan can save your loved ones a great deal of money and frustration down the road.  Wills, trusts, health care directives/living wills, durable powers of attorney, and other estate planning tools allow you to indicate how your financial and medical affairs are to be handled upon your death or incapacitation. If you have sizable assets or special responsibilities, a complex solution may be required to protect your family.

You need a living will / health care directive.
If you suffer serious injury or illness and become incapacitated, a health care directive (commonly referred to as a living will) allows you to direct the type and extent of medical care you receive.  Alternatively, a medical power of attorney allows you to designate a person to make such decisions on your behalf, in accordance with your wishes.  Without this documentation, a guardian or conservator will be appointed by the court to make financial and medical decisions for you. Often, without proper planning, a health care facility will be empowered to make decisions about your care.

You need a will.
If your will clearly designates the recipients of your assets, probate should be simple. If you die intestate – without a will – you may have relinquished control of the distribution of your property to the probate court.  The probate process can be frustrating and expensive for your loved ones.  A little planning now, can prevent a great deal of trouble down the road.

You need a durable power of attorney.
This document allows you to designate a representative to manage your affairs, such as medical and financial issues, if you become incapacitated.  Without a power of attorney in place, the Court may decide who handles these issues on your behalf.  Lyn is an experienced probate and estate planning lawyer, and will help you choose the person best qualified to handle this responsibility.

Trusts can protect your interests.
Lyn has extensive experience helping clients utilize trusts to preserve wealth, provide for children, and become eligible for maximum Medicaid benefits.  If established five years before your need for Medicaid benefits, a supplementary needs trust can help you preserve assets while taking advantage of government benefits for long term care, assisted living services, and nursing home care.  The firm also has extensive experience helping clients provide for a disabled loved one through a special needs trust, and minimize tax liability by taking advantage of living trusts (also known as family trusts and revocable trusts).
